Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CampaignVerdict application and website (the "Service"), operated by Campaign Verdict LLC ("CampaignVerdict", "we", "us"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

CampaignVerdict is an analytics tool that reads advertising performance data, compares it to industry benchmarks, and produces written diagnoses, verdicts, and reports to help advertising professionals interpret campaign performance. The Service is provided for informational and decision-support purposes.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account credentials, and for all activity under your account. Notify us promptly of any unauthorised use.

3. Connecting advertising accounts

You may connect Meta Ads, Google Ads, or other advertising accounts to the Service. By doing so, you authorise us to access the relevant performance data on a read-only basis, and you confirm you are permitted to grant that access for the accounts you connect. The Service does not create, modify, pause, or spend within your ad accounts. Your use of connected platforms remains subject to those platforms' own terms.

The verdicts, benchmarks, recommendations, and reports the Service produces are analytical guidance generated in part by automated and AI systems. They may contain errors or omissions and are not professional, legal, financial, or investment advice. You are responsible for reviewing any output and for the decisions you make about your (or your clients') advertising. We do not guarantee any particular advertising result, cost, or performance outcome.

6. Your content

You retain ownership of the data and content you provide or connect. You grant us a limited licence to process it solely to operate and improve the Service and to deliver results to you, as described in our Privacy Policy.

7. Intellectual property

The Service, including its software, design, and content (excluding your data), is owned by us and protected by intellectual-property laws. Except for rights we expressly grant you, no licence is transferred by these Terms.

8. Fees

Some features may require payment. Where fees apply, they will be disclosed to you before you incur them, and payment terms will be presented at the point of purchase.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the fullest extent permitted by law, CampaignVerdict and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or US $100.

11. Termination

You may stop using the Service and disconnect your accounts at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the courts located in that jurisdiction, unless applicable law provides otherwise.
